Get Your Hospital's Share of the $2.8 Billion BCBS Class Action Antitrust Lawsuit Settlement Before it’s Too Late.
Click here to go to the official class action antitrust settlement website.
At that website you will find instructions on how to submit a claim.
The claim period is from July 24, 2008 to October 4, 2024.
Your claim must be filed by 7/29/25.
Consider the following 4 questions before submitting a claim:
- Why should a lineage search be done before submitting the claim? A thorough lineage search will quickly identify the hospital's affiliates. A hospital affiliate is any entity that has a business connection to the hospital that is potentially eligible to participate in the settlement [e.g. surgical center, physician groups, medical equipment provider etc.]. Not performing a lineage search may result in omitting qualified affiliates. That can cost the hospital a lot of money.
- Is every hospital affiliate eligible to participate in the settlement? Not likely, but eligibility is determined on an affiliate by affiliate basis. It's very likely though, that a great many affiliates are eligible for participation. But an eligible affiliate is not always a qualified affiliate. Properly submitting a claim that only includes qualified affiliates... while also excluding all non-qualified affiliates... requires specialized skillsets and time. It may be too much to ask of even the best hospital staff. Especially so with a 7/29/25 deadline. Failure to include all qualified affiliates may cost the hospital a lot of money.
- Will your claim include BCBS underpayments? Not including BCBS underpayment amounts in your claim will very likely cost the hospital a lot of money. Underpayments are defined as money legally owed by BCBS to the hospital on batches of claims that have already been completely through the hospital’s Revenue Cycle Management System. Underpayments from all payors, which includes BCBS… are very likely costing your hospital 10% to 20% of current yearly revenue. If your hospital can’t currently document and collect underpayments from BCBS, then how can your hospital include those underpayment amounts in your claim? Many of your affiliates are also dealing with this very same problem.
- "Default" or "Alternative" Method? If the "Default Method" is chosen... then the hospital's staff won't have to estimate or validate the amount of the claim. This will undoubtedly save the hospital's staff a tremendous amount of time. It will also very likely cost the hospital a lot of money. This is due to the inherent limitations associated with "Default Method"... some of which we've already gone over. If the "Alternative Method" is chosen... then the hospital's staff must estimate the amount of the claim and then be prepared to validate the claim. The "Alternative Method" should result in more money for the hospital as compared to the "Default Method." But the "Alternative Method" can be labor intensive and strain the hospital's staff. And the hospital will still very likely lose out on a lot of money for the reasons already covered [see above].
If all 4 of those questions listed aren’t addressed properly before you submit your claim, then your hospital will very likely receive only a fraction of what they’re legally entitled to.
Properly submitting a timely claim means more bottom-line cash for the hospital... plus no disruptions, no strain and no hassles for anyone working at the hospital.
Properly submitting a claim though... requires a lot of specialized expertise.
In my 24+ years as a consultant I have found only 1 company that can address all 4 of those questions properly.
